1 Acceptance of Terms

By accessing or using The First Planet website and services, you confirm that you are at least 18 years of age and legally capable of entering into binding contracts under applicable Indian law. These Terms constitute a legally binding agreement between you and The First Planet.

Your continued use of the platform after any updates to these Terms will constitute your acceptance of the revised Terms. We recommend reviewing this page periodically.

2 Services Provided

The First Planet provides a real estate platform enabling users to:

• Browse and search residential and commercial property listings in Mohali, Chandigarh, and nearby regions
• List properties for sale, rent, or lease
• Connect with property owners, developers, and prospective buyers or tenants
• Access information on residential plots, industrial plots, apartments (basic and luxury), showrooms, offices, and booth shops
• Explore featured projects including partner developments such as Olympia Legend Towers
• Schedule property consultations and viewings with our agents

We act as an intermediary platform. The First Planet does not directly own all properties listed on the platform and is not a party to transactions between buyers, sellers, landlords, and tenants unless otherwise stated.

3 User Accounts

To access certain features of our platform, you may be required to create an account. By creating an account, you agree to:

• Provide accurate, current, and complete information during registration
• Maintain the security and confidentiality of your login credentials
• Notify us immediately of any unauthorised access or use of your account
• Accept responsibility for all activities that occur under your account
• Not create multiple accounts for the same individual or entity
• Not transfer or sell your account to any third party

We reserve the right to suspend or terminate accounts that violate these Terms or engage in activities that harm other users or the integrity of our platform.

4 Property Listings

Property listings on The First Planet are provided for informational purposes. While we make reasonable efforts to ensure accuracy, we do not guarantee the completeness, accuracy, or currency of any listing.

• Property details including price, area, availability, and specifications are subject to change without notice
• Images and renders are for illustrative purposes and may not represent the final property
• Users who post listings represent and warrant that they have the legal right and authority to list the property
• Fraudulent, misleading, or duplicate listings are strictly prohibited and will be removed
• We reserve the right to reject, modify, or remove any listing at our sole discretion

5 Transactions & Fees

The First Planet may charge fees for certain services, including property listing promotions, consultation services, or brokerage. Where applicable:

• All fees will be clearly communicated to you before you incur any charge
• Brokerage fees are governed by a separate agreement and applicable Indian regulations
• Payment for properties is made directly between buyers and sellers or landlords and tenants; The First Planet is not a payment intermediary unless explicitly stated
• Taxes including GST applicable on services rendered by The First Planet shall be payable by the user as per prevailing rates
• All fees paid for platform services are non-refundable unless otherwise agreed in writing

6 User Obligations

As a user of our platform, you agree to:

• Use the platform solely for lawful purposes related to real estate search, listing, buying, renting, or selling
• Provide truthful and accurate information in all interactions with our platform and team
• Communicate respectfully with The First Planet staff, agents, and other users
• Honour scheduled appointments and viewings or provide advance notice of cancellation
• Not circumvent the platform to engage in transactions outside of our oversight in violation of any agreement with us
• Comply with all applicable Indian laws, including the Transfer of Property Act, RERA, and taxation regulations

7 Prohibited Activities

The following activities are strictly prohibited on our platform:

• Posting false, misleading, or fraudulent property listings
• Scraping, harvesting, or collecting user data or property information without our written consent
• Using automated bots, scripts, or tools to interact with the website
• Attempting to gain unauthorised access to our systems or databases
• Impersonating any person, company, or property owner
• Engaging in money laundering, fraud, or any other financial crime through the platform
• Uploading malicious software, viruses, or harmful code
• Reproducing, distributing, or commercially exploiting our content without authorisation

8 Intellectual Property

All content on The First Planet website—including but not limited to text, property descriptions, photographs, graphics, logos, icons, software, and design—is the property of The First Planet or its content suppliers and is protected by applicable Indian and international intellectual property laws.

• You may not copy, reproduce, republish, upload, post, or distribute our content without prior written permission
• You may view and print pages for personal, non-commercial use only
• The "The First Planet" name and logo are trademarks of the company and may not be used without authorisation
• User-generated content (such as property listing text and photos you upload) remains your property, but you grant us a royalty-free licence to display it on the platform

9 Disclaimers

Our website and services are provided on an "as is" and "as available" basis without any warranties of any kind, express or implied, including but not limited to:

• No warranty that the website will be uninterrupted, error-free, or free from viruses
• No warranty regarding the accuracy, reliability, or completeness of property information
• No warranty that any property listed will remain available at the stated price or on the stated terms
• No guarantee of investment returns or property value appreciation

The First Planet does not provide legal, financial, or investment advice. All property-related decisions should be made after independent professional consultation.

10 Limitation of Liability

To the maximum extent permitted by applicable law, The First Planet, its directors, employees, agents, and partners shall not be liable for:

• Any direct, indirect, incidental, special, consequential, or punitive damages arising from your use of the platform
• Losses arising from inaccurate property information, failed transactions, or disputes between buyers and sellers
• Any loss of data, profits, goodwill, or business opportunities
• Damages arising from third-party websites linked from our platform

Where liability cannot be excluded by law, our total liability to you shall not exceed the amount paid by you to us in the three months preceding the claim.

11 Indemnification

You agree to indemnify, defend, and hold harmless The First Planet and its affiliates, directors, officers, employees, agents, licensors, and partners from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising out of or related to:

• Your use of our platform in violation of these Terms
• Any content you post, upload, or transmit on our platform
• Your violation of any applicable law or the rights of any third party
• Any dispute between you and another user, buyer, seller, landlord, or tenant

12 RERA Compliance

The First Planet operates in compliance with the Real Estate (Regulation and Development) Act, 2016 (RERA) and the rules notified thereunder in the states where we operate. We are committed to transparent, fair, and accountable real estate services.

• Developers and builders listing projects on our platform are responsible for ensuring their projects are duly registered under RERA
• RERA registration numbers, where available, are displayed on relevant project pages
• Buyers are encouraged to verify RERA registration independently via the official state RERA portals
• Any disputes arising from real estate transactions may be referred to the appropriate RERA authority

13 Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Mohali, Punjab, India.

Before initiating legal proceedings, the parties agree to attempt to resolve any dispute in good faith through direct negotiation. If unresolved within 30 days, disputes may be referred to mediation or arbitration under the Arbitration and Conciliation Act, 1996, before resorting to litigation.

14 Modifications to Terms

The First Planet reserves the right to modify these Terms at any time. When we make material changes, we will update the "Last Updated" date at the top of this page. We may also notify you via email or a prominent notice on our platform. Your continued use of our services after such changes constitutes your acceptance of the revised Terms.
